Sexual Harassment Policy

The City of Hampton is committed to providing a work environment free of any form of sexual harassment or related intimidation. Sexual harassment is prohibited within the City of Hampton.

Harassment on the basis of sex is a violation of Section 703 of Title VII of the 1964 Civil Rights Act. Sexual harassment is unwelcome sexual advances, requests for sexual favors, and/or other verbal or physical conduct of a sexual nature when:

  1. Submission to such conduct is made either explicitly or implicitly a term or condition of an individual´s employment.
  2. Submission to, or rejection of, such conduct by an individual is used as the basis for employment decisions affecting such individual.
  3. Such conduct has the purpose or effect of unreasonably interfering with an individual´s work performance or of creating an intimidating, hostile, or offensive working environment.

Within the city government, a supervisor who uses implicit or explicit coercive sexual behavior, verbal or otherwise, to control, influence, or affect the career, salary, job, or work performance of an employee is considered as engaging in sexual harassment. Similarly, an employee who behaves in this manner is engaging in sexual harassment. The subject of the harassment and the alleged harasser may be male or female. The subject does not have to be of the opposite sex. The alleged harasser may be a non-employee.
